Introduction

The purpose of these General Terms and Conditions of Sale (hereinafter, “the GTCS”) is to govern the contractual relationship between the company Tecnodrive (hereinafter, “the Merchant”), and any person wishing to make a purchase (hereinafter, “the Customer”) on the website https://tecnodrive.es (hereinafter, “the Website”).

1. Acceptance of the GTCS

By using https://tecnodrive.es or placing an order through it, the Customer agrees to be bound by these GTCS and the Privacy Policy, without any restrictions or reservations.

Before placing an order, the Customer must check the box stating: “I acknowledge that I have read and accept the General Terms and Conditions of Sale and the Privacy Policy.”


2. Independence of clauses

The nullity of any clause in the GTCS shall not affect the validity of the GTCS as a whole.


3. Modification of the GTCS

The Merchant reserves the right to modify these GTCS at any time, and such modifications shall take effect, if applicable, as soon as they are published on https://tecnodrive.es. The new GTCS shall apply to any new orders.


4. Intellectual property

The content of the website https://tecnodrive.es (logos, texts, trademarks, images, and videos) is the intellectual property of the Merchant. Any total or partial reproduction is prohibited without the Merchant’s express prior authorization.


5. Product availability

Any order placed through https://tecnodrive.es is subject to product availability. If, after placing an order, the products are not available, the Customer will be notified at the email address provided that the order has been cancelled. The Merchant reserves the right to withdraw products from https://tecnodrive.es and to modify any information or illustrations at any time.

The product descriptions on https://tecnodrive.es do not constitute contractual documentation. Therefore, if there are differences that do not affect the essential specifications of the products, the Merchant declines all liability.


6. Prices and shipping costs

The prices shown on https://tecnodrive.es are indicated in EUR €, but do not include shipping costs. Therefore, shipping costs will be added to the total amount owed by the Customer, in accordance with Article 7 of this document.

The Merchant reserves the right to modify prices at any time. In such cases, the price change will apply only to future orders and not to orders already in process.

If a pricing error occurs, the Merchant reserves the right to correct it, and will inform the Customer as soon as possible at the email address provided, offering the option to proceed with the order at the correct price or to cancel it.


7. Shipping methods and costs

Provided the products are available (see Article 5), the Merchant undertakes to deliver the Customer’s order within 30 days from receipt of the order confirmation at the Customer’s email address.

When placing the order, the Customer must choose a delivery method from those offered on https://tecnodrive.es. Shipping costs can be consulted on the carriers’ websites.


8. Method of payment

The available payment methods are those shown on the Website at the following address: https://tecnodrive.es.

The Merchant reserves the right to modify this list at any time, without affecting orders already in progress.

Payment must be made within a maximum period of 30 days following receipt of the order.

In the event of total or partial non-payment within the aforementioned period, the Customer must pay the Merchant late payment compensation equal to three times the legal interest rate, without prior notice. Late payment penalties will be calculated on the outstanding amount, including taxes, and will take effect once the payment deadline specified in this article has passed.


9. Formation of the contract

By placing an order on https://tecnodrive.es, the Customer guarantees that they are at least 18 years old and legally capable of entering into a contract.

The Customer guarantees that they are a professional placing an order within the framework of their commercial activity. These GTCS are intended for professionals acting exclusively for purposes consistent with the scope of their professional activity. It is expressly stated that, as the GTCS apply solely to sales made to a professional buyer acting for professional purposes, no right of withdrawal applies.

To place an order, the Customer confirms their cart and proceeds to payment, in accordance with Article 7. A sales contract between the Customer and the Merchant is only valid once the Customer receives an order confirmation email at the email address provided.

It is the Customer’s responsibility to verify the accuracy of the order content before confirming the cart and proceeding to payment. The cart may be modified before confirmation and payment.


10. Order refusal

The Merchant reserves the right to refuse any order.


11. Transfer of ownership

Products will remain the property of the Merchant until the Customer has paid the full amount of the order and the shipping costs.

Risk transfers to the Customer upon delivery.


12. Legal guarantee

In the event of non-conformity of the order at the time of delivery, the Merchant shall comply with its obligations regarding the legal guarantee. The Customer may contact customer service as set out in Article 7, and must exercise their legal guarantee within two months from delivery. The Customer may request a replacement of the non-conforming order or return it and request reimbursement for defective products. In case of return, the Customer must explicitly notify the Merchant and send the complete order, in its original undamaged condition and packaging, along with all accessories.


13. Hidden defects

The Customer may contact customer service, in accordance with Article 11, if defects are observed at delivery that render the products unfit for use. The Customer may request a discount or return the order for reimbursement of defective products. In case of return, the Customer must explicitly notify the Merchant and send the complete order in its original undamaged condition and packaging with all accessories.


14. Right of withdrawal

In accordance with Article 102 of Royal Legislative Decree 1/2007 of November 16, which approves the recast text of the General Law for the Defense of Consumers and Users and other complementary laws, the Customer may withdraw within fourteen (14) days following receipt of the order.

16. Force majeure

The Merchant declines all liability for failure or delay in fulfilling contractual obligations due to events beyond its control, acts of force majeure, or third-party actions outside the Merchant’s control.

19. Applicable law and jurisdiction

Sales contracts for products purchased on https://tecnodrive.es are governed by Spanish law.
